Subway ordered to pay fees in wake of suit vs. Canadian network

A Canadian judge ordered Subway to reimburse the Canadian Broadcasting Corp. (CBC) C$500,000 in legal costs stemming from a lawsuit accusing the network of making what the chain called false claims about its chicken sandwiches.

Last fall, Ontario Superior Court Justice Ed Morgan dismissed Subway’s original 2017 lawsuit over a CBC report that Subway’s chicken sandwiches contained 50% soy protein, a claim the chain disputed. The filing asked for C$210 million in damages and called the CBC report “defamatory and absolutely false,” citing tests Subway conducted through two laboratories in 2017. Morgan found that Subway’s legal approach resulted in a “monument to high-end legal work” that sent the network’s legal costs to a total of C$800,000, according to a CBC report.

Morgan also ordered Subway to pay CBC an additional C$178,000 to cover fees and disbursements on top of the C$500,000 figure, the report added.
