Mountaire Farms has settled one of two class action lawsuits filed against it for allegedly polluting the drinking water of residents near its Millsboro, Del., facility, according to local media reports.
The settlement was reached “in principle” in November, “has now been fully funded and our two lawsuits which have been pending in Superior Court since 2018 have now been dismissed,” according to Delaware State News, quoting a release from one of the law firms representing the residents.
The terms of the settlement are confidential. A Mountaire spokeswoman told the newspaper that the company is “unable to comment on this at this time.”
Mountaire still faces a second class action suit. The processor’s efforts to have that case dismissed were denied last month. In December 2019, meanwhile, the company reached an agreement with Delaware’s Department of Natural Resources and Environmental Control regarding spray irrigation and land application permit violations.
